THE CLINCH METHODTM

What Makes Us Different

We're Not Just Your Attorneys.
We're Your "Business Architects."

Investment Deployment Architecture

Merely having money in a bank account is not enough for an E-2 visa. We guide you on how to irrevocably commit your funds ("At Risk" capital) through escrow agreements and strategic asset purchases, ensuring every dollar spent strengthens your legal case.

Consular Pitch Preparation

We do not teach you to memorize your business plan. Instead, we train you to think and speak like a CEO. We prepare you to defend your profit margins, hiring projections, and market strategy so you can command the room during your consular interview.

Scalability & Renewal Roadmap

We don't plan only for the initial visa issuance. We plan for your renewal five years from now. By structuring your business to avoid "marginality" (merely supporting your family) from Day 1, we ensure your business growth secures your long-term status in the U.S.

AUTHORITY & TRUST

Attorney Asim Clinch, Esq.

"My first question to every E-2 investor is this:"

"Is this a business you genuinely want to run, or are you just buying a job to get a visa?"

At CLINCH, we build the legal strategy around a business model that makes commercial sense.

Because in the E-2 world, a failing business means a cancelled visa.

We ensure your immigration foundation is as strong as your business plan.

What is the E-2 Treaty Investor Visa?

The E-2 Visa allows nationals from treaty countries (such as Turkey, UK, Canada, Japan, etc.) to move to the U.S. to direct and develop a business they have invested in. Unlike the EB-5 Green Card, there is no fixed minimum investment amount (e.g., $800,000 is not required). The investment must simply be "substantial" relative to the business type. It is renewable indefinitely as long as the business operates.

Who is this for?

Entrepreneurs: Starting a new company from scratch
Franchise Buyers: Investing in established brands
Business Acquirers: Buying an existing U.S. business
Service Providers: Consultancy, Construction, or Tech firms

Core Benefits

Spouse Work Authorization

Your spouse gets an automatic right to work anywhere in the U.S.

Faster Processing

Often approved in 3-5 months (Premium Processing available for USCIS filings).

Unlimited Renewals

Stay in the U.S. indefinitely as long as your business is active.

Lower Capital Risk

Investment amounts can be significantly lower than EB-5.

Free Education for Children

Your children receive completely free high school education in American public schools. Additionally, in many states, they can qualify for discounted tuition rates as local residents (in-state tuition) for university, rather than being classified as “foreign students.”

Meet Your Business Strategists

Unverified Capital Is Your Biggest Risk. We don't just verify funds; we transform your investment from a mere 'visa requirement' into an irrefutable commercial foundation.

Do You Qualify for the E-2 Visa?

1. Treaty Nationality

You must be a citizen of a country that maintains a commerce treaty with the U.S. (e.g., Turkey, UK, Italy, Japan, Grenada).

2. Substantial Investment

There is no fixed number, but the investment must be sufficient to ensure the business's success.

  • Low Cost Business: Investment should be ~75-100% of value.
  • High Cost Business: Investment can be ~30-50% of value.

3. "At Risk" Capital

The funds must be irrevocably committed (spent or held in escrow) before the visa approval. It cannot be just a loan secured by the business assets.

4. Not "Marginal"

The business must demonstrate the capacity to generate income significantly more than just enough to support you and your family (i.e., you must plan to hire U.S. workers).

Frequently Asked Questions

How much investment is required? Is there a specific minimum limit?

USCIS officers don't just look at the size of the number; they look at whether that capital can keep the business from failing for the next 5 years.

We calculate your investment amount not as a "visa requirement," but as the "lifeblood" of your commercial future in the U.S. Because a poorly planned budget jeopardizes not just your business, but your legal status.

For us, the visa is not the result; it is part of the business strategy.

Can I have my Business Plan written by any consulting firm?

Can I have my Business Plan written by any consulting firm?

You can, but that would be a "form-filling" error. Most business plans are fiction written solely to persuade a visa officer with imaginary numbers. However, the day you get your visa, you are left to face reality.

According to the C L I N C H philosophy, a business plan is not a "petition attachment"; it is your family's financial roadmap in the U.S.

We reject the old-school legal approach where the attorney files the plan without understanding the business. The strategy we build aims not just to get you through the door, but to establish a sustainable life inside.

Does the E-2 Visa close the path to a Green Card?

This is one of the most common and incorrect myths in the industry. While E-2 is a "non-immigrant" visa, with the correct "Future Strategy," it can be transformed into a stepping stone toward a Green Card.

We view the visa as a "mid-point". Transition scenarios like EB-1C (Multinational Manager) or EB-2 NIW (National Interest Waiver) are planned while we are still preparing your E-2 file.

It is not the visa type that traps you; it is a lack of vision.

Why is my spouse's work authorization so important to you?

We manage your family like a "corporation." While the E-2 investor takes the risk to build the business, the spouse obtaining work authorization and entering the corporate American workforce acts as the family's "health insurance" and "fixed income" guarantee.

This is the foundation of C L I N C H's "holistic" approach. Focusing solely on the investor's visa risks the family's social and economic adaptation to the U.S.

We engineer your spouse's career as a load-bearing pillar of this "Life Architecture."

Is it safer to start a business from scratch or buy an existing one (Franchise)?

Security is not found in the brand you buy, but in its alignment with your "life goals". What you dream of achieving in the U.S. comes before technical law for us.

Buying a "guaranteed-looking" business in the wrong state or an unmanageable sector can lead to visa denial or revocation.

We don't hand you a list of "businesses for sale"; we analyze the commercial structure that best fits your capital and capabilities.

What happens if my file is denied? How do you manage the risk?

There are no 100% guarantees in law, but there is 100% "preparation." Traditional lawyers manage the process reactively; they answer only when the officer asks. We act proactively.

While preparing your file, we identify all potential weak points (Achilles' heels) and transform these risks into manageable strategic moves using our "Yellow Frame" methodology.

Working with us is not gambling; it is a calculated construction of the future.

Can I incorporate in Delaware but open my office in Texas?

While technically possible, this harbors serious traps regarding immigration strategy. The "Impact of Wrong State Selection on Visa Status" is greater than you think.

While chasing tax benefits, operational inconsistencies can raise doubts about the "reality" (marginality) of the business.

We don't just file incorporation documents; we ensure that the physical and legal existence of your business is in mathematical consistency with your immigration narrative.

Why don't you offer 'free initial consultations' like other law firms?

Because we don't "sell"; we build "strategy". As C L I N C H, our goal is not to serve everyone, but to work deeply with a limited number of clients who possess the vision to "build a future."

This is a policy of "shortage". We dedicate our time to drafting 5-year development plans for our clients, not answering standard form questions.

A meeting with us is not a "meet and greet tea"; it is a strategic analysis of your life.
