EB1A Is Not a Paperwork Case. It's a Legacy Case.

Most lawyers simply compile documents. We build a narrative that demonstrates you are working at the highest level of your field, with a level of impact that the United States cannot replace.

Av. Asim Clinch, Esq.

A Note from Attorney Asim Clinch, Esq.

"In EB1A cases, evidence alone is not enough. What truly matters is the story your evidence communicates. Our mission is to elevate your achievements into a legacy-level argument that shows you are someone who transforms your field and, as a result, contributes to the United States."

The C L I N C H™ Framework for EB1A Excellence

1. Field Authority Mapping

We position you as a top-tier contributor through global rankings, leadership roles, and influence metrics.

2. Impact-Driven Evidence Strategy

Every publication, patent, award, and citation is transformed into an argument that demonstrates your impact in the United States, not into a simple biography.

3. Future Contribution Blueprint

We design a 5-year U.S. roadmap demonstrating how your continued work advances American innovation.

4. High-Authority Expert Letters

We secure letters from leaders who validate your influence on the field, not your résumé.

Money-Back Guarantee

If your case is denied, your attorney fees are refunded.

What is the EB1A Extraordinary Ability Green Card?

The EB1A is the "First Preference" employment-based Green Card, reserved for individuals who have risen to the very top of their field in the sciences, arts, education, business, or athletics. Unlike most other categories, you do not need a U.S. employer or a labor certification (PERM). It is the fastest path to a Green Card for those who can prove sustained national or international acclaim.

Who is this for?

Scientists & Researchers: With high citation counts and original contributions.
Artists & Musicians: With exhibitions, commercial success, or press coverage.
Business Leaders: Executives with critical roles in distinguished organizations.
Athletes & Coaches: With national awards or international competition history.

Core Benefits

Self-Petition

You are in full control. No sponsor means no risk of losing your case if you change jobs.

No Backlog (Usually)

Priority dates are often "Current" for most countries, meaning no years-long waiting lists like EB-2 or EB-3.

Family Security

Your spouse and unmarried children under 21 receive Green Cards with you.

Premium Processing

Unlike EB-2 NIW (which takes months), EB1A allows for a 15-day decision window.

Evaluate Your Extraordinary Ability Case

Meet with our EB1A attorneys to see if your achievements qualify.

Do You Qualify for the EB1A?

You do not need a Nobel Prize. However, you must meet at least 3 of the following 10 criteria:

1

Prizes & Awards

Receipt of lesser nationally or internationally recognized prizes or awards.

2

Membership

Membership in associations that require outstanding achievements of their members.

3

Media Coverage

Published material about you in professional or major trade publications.

4

Judging Others

Participation as a judge of the work of others (Peer review, jury, etc.).

5

Original Contributions

Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance.

6

Scholarly Articles

Authorship of scholarly articles in professional journals or major media.

7

Display of Work

Evidence that your work has been displayed at artistic exhibitions or showcases.

8

Leading Role

Performance in a leading or critical role for distinguished organizations.

9

High Salary

10

Commercial Success

Evidence of commercial successes in the performing arts (Box office receipts, sales).

The "Final Merits" Strategy: Why You Need Clinch Law Firm

Meeting 3 criteria is only Step 1. The real challenge is the "Final Merits Determination" (Kazarian Step), where USCIS decides if you are truly at the top. This is where most self-filers fail, and where we excel.

Money-Back Guarantee

We are confident in our evaluation. If we take your case and it is denied, we refund your attorney fees.

Kazarian Strategy

We structure your argument to satisfy the complex "Final Merits" legal standard.

Evidence Curation

We don't just dump documents. We curate a narrative that proves your "Sustained Acclaim."

Letter Drafting

We help draft the robust Independent Expert Letters needed to validate your impact.

Frequently Asked Questions About EB1A

What is the "Final Merits Determination" I hear about?

This is the most critical part of an EB1A case. USCIS uses a two-step analysis (based on the Kazarian court case). Step 1 is counting the criteria (meeting 3 out of 10). Step 2 is the 'Final Merits Determination,' where the officer looks at the totality of the evidence to decide if you are truly one of the small percentage who have risen to the very top of your field. Meeting 3 criteria does not guarantee approval without passing Step 2.

Do I need a Nobel Prize or Olympic Medal to qualify?

No. While a one-time major international award (like a Nobel or Oscar) automatically qualifies you, 99% of applicants qualify through the alternative method: meeting at least 3 of the 10 regulatory criteria listed above.

What is the difference between EB1A and EB-2 NIW?

Both allow self-petitioning (no employer needed). However, EB1A has a much higher standard ('Extraordinary Ability' vs. 'Exceptional Ability') but offers faster processing (Premium Processing) and usually has no waiting list (Visa Bulletin is often current). EB-2 NIW is slightly easier to qualify for but often has a backlog for a Green Card. We often recommend filing both simultaneously to hedge your risk.

I have an O-1 Visa. Is EB1A guaranteed?

No. The O-1 visa ('Extraordinary Ability' non-immigrant) and EB1A ('Extraordinary Ability' immigrant) have very similar criteria, but the legal standard for EB1A is interpreted much more strictly by USCIS. An O-1 approval is a good sign, but it does not guarantee an EB1A win. We need to update your evidence to show sustained acclaim.

Can I file EB1A if I am not in the U.S.?

Yes. You can apply from anywhere in the world. Once your I-140 petition is approved, you will go through 'Consular Processing' at the U.S. Embassy in your home country to receive your immigrant visa.

How many citations do I need as a researcher?

There is no 'magic number' written in the law. However, practically speaking, having fewer than 100-200 citations can be challenging unless you can prove that your field is very niche and your work is impactful in other ways (e.g., commercial licenses, industry use). Context matters more than raw numbers.

Can I pay for faster processing?

Yes. Unlike the standard process which takes 6-12 months, you can pay a Premium Processing fee ($2,805) to USCIS. This guarantees that they will adjudicate your I-140 petition (Approve, Deny, or Issue RFE) within 15 business days.

What defines a "Leading or Critical Role"?

You must prove that the role you performed was critical to the organization as a whole, AND that the organization itself is distinguished. For example, being a 'Senior Engineer' at Google might not be enough unless you led a project that impacted the company's core revenue or technology.

If my EB1A is denied, does it affect my other visas?

Generally, no. An EB1A denial does not revoke your current status (like H-1B or O-1) nor does it prevent you from applying for other categories like EB-2 NIW. In fact, many clients file EB1A and EB-2 NIW at the same time for safety.
