Do You Qualify for the EB2 NIW?
First, you must qualify for the EB-2 category through an advanced degree or exceptional ability. The separate NIW criteria are explained below.
A. Advanced Degree
- A U.S. advanced degree or foreign equivalent in a qualifying profession; OR
- A U.S. bachelor's degree or foreign equivalent, plus at least 5 years of progressive, post-baccalaureate experience in the specialty.
B. Exceptional Ability
Generally, evidence must satisfy at least 3 of these 6 criteria. USCIS then considers the evidence as a whole to determine whether your expertise is significantly above that ordinarily encountered in your field.
