What is the Marriage-Based Green Card?
Marriage to a U.S. Citizen or Lawful Permanent Resident is one of the fastest paths to permanent residency. However, USCIS scrutiny is high to prevent marriage fraud. Whether you are applying from within the U.S. (Adjustment of Status) or from abroad (Consular Processing), we prove your relationship is "Bona Fide" (genuine) and navigate the complex financial sponsorship rules for you.
Who is this for?
Core Benefits
Work Authorization (EAD)
Get permission to work in the U.S. while waiting for your Green Card.
Travel Freedom
Obtain "Advance Parole" to travel internationally without abandoning your application.
Fast-Track Citizenship
Spouses of U.S. Citizens can apply for Citizenship in just 3 years (instead of the usual 5).
Marriage Green Card Legal Support
Do You Qualify for a Marriage Green Card?
To qualify, you must meet three critical requirements:
1. A Legally Valid Marriage
Your marriage must be legally recognized in the place where it occurred. (Religious ceremonies without legal registration may not count).
2. A "Bona Fide" Relationship
You must prove that your marriage is real and not entered into solely for immigration benefits. Evidence includes joint bank accounts, lease agreements, photos, and shared life history.
3. Financial Sponsorship
The U.S. spouse (Sponsor) must meet income requirements (125% of the poverty guidelines) and file an Affidavit of Support (Form I-864).

Frequently Asked Questions
What is the difference between Adjustment of Status and Consular Processing?
Adjustment of Status is for spouses already inside the U.S. (e.g., on a student or tourist visa). Consular Processing is for spouses currently living outside the United States. We help you decide which path is safer and faster for your situation.
How much income do I need to sponsor my spouse?
Generally, the U.S. sponsor must earn at least 125% of the Federal Poverty Guidelines for their household size. If your income is insufficient, we can help you use a "Joint Sponsor" to meet the requirement.
Will we have a Green Card interview?
Most marriage-based cases require an in-person interview at a USCIS office or U.S. Embassy. The officer will ask questions to verify your marriage is real. Clinch Law Firm provides extensive interview preparation to ensure you answer confidently.
Can I work while waiting for my Marriage Green Card?
Yes! If you are applying for Adjustment of Status within the U.S., we file Form I-765 along with your Green Card application. This grants you a Work Permit (EAD) usually within 3-6 months, allowing you to work legally while the case is pending.
What if I overstayed my visa? Can I still marry and get a Green Card?
If you entered the U.S. legally (with a visa) and married a U.S. Citizen, your visa overstay is typically "forgiven" automatically during the Green Card process. However, this rule is complex, and you should consult with our attorneys immediately.
How long does the process take?
Timelines vary by location. Adjustment of Status typically takes 8-14 months. Consular Processing takes 12-18 months. Spouses of Green Card holders (F2A) may face longer waits depending on the Visa Bulletin.
What is a "Conditional" Green Card?
If you have been married for less than 2 years when your Green Card is approved, you will receive a Conditional Green Card valid for 2 years. You must file to remove these conditions (Form I-751) 90 days before it expires to get your 10-year card.
