One of the most useful questions in EB-1A preparation is “What other document can I add?” but “What claim does this document prove?” is the question. Having an award, news or reference letter on file may not be sufficient; The document's scope, context, and relationship to the person's level in the field should be explained. This guide provides a working method for document preparation based on the criteria in editing. 1
First create an evidence map
Against each claim, write the original document, the confirming record, and the missing explanation. For example, for a “critical role,” not only the mission letter should be considered, but also the reputation of the organization and the person's impact on certain results. Ten letters repeating the same claim do not automatically complete the missing underlying record. 12
This map is not a required USCIS form. The aim is to make visible the difference between finding the document and meeting the legal criterion. Tracking the dates and English translation status of sources within the same work also helps file integrity.
Certificate alone may not be enough for the award
The award certificate indicates that the award has been awarded. However, selection rules, nature of the organization, scope of candidates and independent information may be required to explain whether this is a nationally or internationally recognized achievement award. Participating in a competition or making a payment and entering the list should be distinguished from being selected based on success. 1
Let's consider an imaginary example: A designer has won an award. The legal claim will be more understandable if the case explains not only the certificate but also in which category it was competed in, how the work was evaluated and the place of the award in the field. This example does not say that a particular award qualifies for an EB-1A.
Attribution and usage can refer to different things
Citation counts can provide data on academic visibility. However, the publication habits of the field, the independence of citations, and the nature of the individual's contribution are important. Along with high numbers, documentation showing how the research was used can help explain why the contribution is important. 1
A method may have been mentioned only in the bibliography by another team; in another case, it is integrated into an actual product or application. These two records do not have the same effect. If there is a claim of use in the case, it should be clearly stated what the use is and which work of the applicant it is based on.
Maintain distinction between people, companies and products in news
News that a company has received investment may not directly convey the extraordinary talent of the applicant. If the news covers the person's role and work, a different connection can be made. The entire text should be studied; A scope without content should not be claimed just because the person's name is mentioned somewhere. 1
The date of publication, author, affiliation and nature of the medium can be recorded. The distinction between paid promotion, press release and independent news should not be hidden. It is more important to explain the true nature of the document than to present it under a more impressive title. 2
How would you explain the impact of the critical role?
The critical role is not just the title of “director,” “chairman,” or “senior expert.” The individual's influence on the organization's significant activities must be demonstrated. A connection can be made with decision authority, scope of responsibility, importance of the work managed and concrete results. The distinguished reputation of the organization is also another factor. 1
For example, if the person has technical approval authority for the release of a product, the mandate letter can explain this authority and why it is important. Rather than writing off all revenue from the product as personal achievement, the boundaries of an individual's verifiable contribution should be maintained. Organizational success and personal role can support each other; They are not interchangeable.
Look for a source of information in your reference letter, not praise
The letter writer must explain how he knows the person, which study he evaluated, and what concrete information he based his opinion on. The evaluation of an independent expert and the direct manager's personal observation can provide different types of information. Both can make sense in the appropriate context; The size of the title alone does not determine probative value. 1
The letter must be consistent with the actual records in the case. Exaggerating one's role or giving numbers that have no source may create credibility problems. The letter should be prepared as a document explaining the significance of the available facts, not as a tribute that is expected to replace missing evidence. 2
Final check: Consistency, date and applicability
Compare name, date, position and institution information in documents. Note the source of each significant figure. Do not carry back an achievement that does not exist at the application date. The criterion to which the evidence can be applied is as important as its reality; It is not right to apply the criterion of artistic exhibition to every technical presentation or the criterion of commercial success to every company income. 12
The result of this preparation should not just be a larger file. The ideal outcome is a narrative that neither understates nor exaggerates the person's accomplishments, with the evaluator able to understand the record against which each key claim can be checked.
