Art and cinema and television do not have the same legal details in O-1B. For the correct answer, one must know the nature of the actual job in the United States as well as the person's profession. The following questions address common points of confusion between these two areas and application procedures. 1

Is O-1B only for famous actors?

No. The category may include eligible arts and film-television professionals. However, the profession name alone is not sufficient; The required standard of achievement and US business must be demonstrated. Being publicly recognized by everyone is not the same question as being legally recognized in a particular field. 1

Why are there differences between art and cinema-television rules?

The framework of distinction is applied to art, and the framework of extraordinary achievement is applied to cinema and television. The rules for advisory opinion and comparable evidence are also different. Preparing the case in the correct framework affects which documents can be used. No other subfield should be chosen simply because it seems easier. 1

I didn't win an award, but I was nominated; Could it be useful?

Winning a significant national or international award or qualifying candidacy may be one way of evidence in O-1B issuance. The nature of the nomination, the recognition of the award, and the person's affiliation must be demonstrated. Not every local candidacy or participation is automatically sufficient. This rule should not be carried over to other visa categories. 1

Is the case definitely approved if it meets three criteria?

No. The criteria must actually be met and the total enrollment must demonstrate the required standard of achievement. It is not enough to open three headlines or add the same promotional material in three places. The role and nature of the evidence and its connection to personal success should be explained. 1

Can I get an O-1B if I have a lot of followers?

Number of followers may explain the reach of some projects; but by itself it is not an automatic O-1B criterion or approval rule. The nature of recognition, independent evaluation, commercial or critical success, and other evidence are examined. Access and legal success standards should not be considered the same. 1

Does the production published on the internet fall into the category of art?

Just publishing it on the internet does not determine the outcome. The nature of the production and the person's actual task is examined. In a business with digital distribution, cinema-television rules may come into question. The application framework should be determined by the actual nature of the business rather than the name of the platform. 1

Is the same advisory opinion sufficient in every O-1B file?

No. Consultation conditions for art and cinema-television files may be different. There are special rules regarding the appropriate labor organization and management organization for cinema and television. A general reference letter does not automatically replace these conditions. Applicable exceptions are also reviewed. 1

Can comparable evidence be used in every O-1B?

In certain cases where the criteria in art files do not easily apply to the profession, comparable evidence may be considered. The same general option does not apply to cinema and television files. For this reason, category selection and evidence planning must be done correctly from the beginning. Comparable evidence does not remove the standard of success. 1

Can I work freelance with Agent?

Agent may submit an application covering multiple jobs that are properly documented. However, this is not an open work permit for every desired job. Employers, contracts and itinerary are important. When a new employer or fundamental change occurs, the necessary new or change application must be evaluated. 1

How many years is O-1B issued?

Initial approval for the period required by the relevant activity or work may be up to a maximum of three years. Extensions for the continuation of the same event are generally evaluated for one-year periods. Not every file automatically receives three years. The requested time must be supported by actual work. 1

Can my spouse work with O-3?

O-3 status does not authorize self-employment. The family status of eligible spouses and children is evaluated; The principal's work permit is not automatically transferred to the family. It should also be examined whether there is a separate work authorization or appropriate status path for the spouse. 12

Is the transition from O-1B to EB-1A automatic?

No. EB-1A is a separate permanent residence category and has a high standard of achievement by its own criteria. O-1B is not the same as art evaluation. Previous approval does not eliminate the need to re-examine the evidence and suitability in the new file. 31
