O-1A Application Requirements and Eight Criteria of Evidence

O-1A demonstrates outstanding ability and ongoing national or international recognition in science, education, business, or sports. Major internationally recognized awards or evidence that meets at least three of eight criteria may be submitted. However, the overall enrollment must also demonstrate the required high standard of achievement. ¹

1. Awards

National or international awards recognizing excellence in the field may be considered. The selection conditions, scope and recognition of the award are as important as its name. A certificate of participation or a general recognition given in exchange for a fee does not automatically meet this criterion. ¹

It must be explained that the applicant received the award, why the award was given, and the nature of the selection process. The individual's affiliation and role in the team award should also be clear. ¹²

2. Selective memberships

If outstanding achievements evaluated by recognized experts in the field are required for membership, the relevant criterion may be evaluated. Membership obtained solely on the condition of paying dues or working in the profession does not have the same evidentiary value. ¹

The organization's membership class, admission conditions, and the class to which the person has been accepted must be documented. General organizational promotion does not replace the selective admission requirement. ¹

3. Published materials about the person

Material about the person and their work may be used in professional publications, major professional publications, or other major media. The quality of the publication, date, author and the connection of the content to the person are evaluated. A self-written article is not automatically the same with this criterion. ¹

A news story that only mentions the company's name may be limited if it does not explain the individual's contribution. The difference between news, advertising and promotional content should be shown honestly. ²

4. Evaluating the work of others

Having evaluated the work of others in the same or related field, individually or as a board member, can be used. Receiving an invitation is not the same as actually making an evaluation. It must be documented that referee or jury duty occurred. ¹

The field of work being evaluated and the scope of the task must be understood. Routine personnel evaluation within general management should not be considered the same as this criterion in all cases. ¹

5. Significant original contributions

Contributions that are original and of great importance to the scientific, academic or business world may be evaluated. The existence of a new idea or patent does not always indicate importance by itself. It should be explained what the contribution is and why it is important in the field. ¹

Application, use, professional impact, and independent evaluations may be meaningful. Instead of a general letter of praise, concrete contribution and basis should be shown. It should not be expected that the same type of impact certificate exists in every sector. ¹²

6. Scientific writing

Scientific article writing in professional journals or other major media may be considered. Not every blog post or company introduction is considered a scientific article. The nature of the content, place of publication and authorship of the person must be indicated. ¹

Meeting this criterion and demonstrating the paper's major impact in the field are two different matters. When using a document with different criteria, the separate condition of each criterion should be explained. ¹

7. Critical or essential mission in recognized organizations

Work in a critical or essential capacity in organizations with distinguished reputations is considered. The reputation of the organization and the importance of the person in the position should be shown separately. Holding any position in a large company is not automatically enough. ¹

Task results, responsibilities and role within the organization can be explained. Title should not replace personal contribution. ²

8. High fee or payment

The fact that a high fee has been received for the services or that it has been agreed appropriately can be evaluated within the scope of the relevant criterion. Appropriateness of field, task, geography and comparison data is important. Gross company income should not be confused with one's own wages. ¹

What conditions exist beyond the evidence?

Appropriate U.S. employer or agent, employment contract or appropriate summary of oral agreement, work plan, and general advisory opinion are required. If the criteria do not easily apply to the profession, the relevant comparable evidence rule may be examined; This does not remove the standard of achievement. ¹

Opening three criteria headings does not provide automatic approval. The entire dossier must clearly show that the person is well known and will work in this field in the United States. ¹
